· “Agreement”: Means all terms and conditions found in this form.
· “You” or “Your”: Means the person identified as the renter, any person signing this Agreement, and any person to whom charges are billed by us at its or the renter’s direction.
· “We”, “our”, or “us”: Means the Company, the independent business named in this Agreement.
· “Authorized Rider”: Means the renter listed by us on this Agreement, provided person has a valid motorcycle license for at least one year and is at least 21 years of age.
· “Motorcycle”: Means the motorcycle identified in this Agreement and any motorcycle we substitute or billed for it, and all its tires, tools, accessories, equipment, keys and Motorcycle documents.
· “Physical Damage”: Means damage to, or loss of, the Motorcycle caused by collision or upset; it does not include comprehensive damage, such as damage to, or loss of, the Motorcycle due to theft, vandalism, act of nature, riot or civil disturbance, hail, flood or fire.
· “Loss of use”: Means the loss of our ability to use the Motorcycle for any purpose due to damage to it during this rental. Loss of use is calculated by multiplying the number of days from the date the Motorcycle is damaged until it is repaired, times the daily rental rate.
· “Bad Weather”: Weather includes, but is not limited to, heavy rain, severe fog, sandstorms, strong winds, flooding, or any weather condition that, in the Company’s reasonable judgment, makes riding unsafe.
- The renter must hold a valid motorcycle driving license accepted in the UAE for at least one year.
- The renter must be 21 years or older.
3. RENTAL, INDEMNITY AND WARRANTIES
This is a contract for the rental of the Motorcycle. We may repossess the Motorcycle at your expense without notice to you, if the Motorcycle is abandoned or used in violation of law or this Agreement.
You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees we incur resulting from, or arising out of, this rental and your use of the Motorcycle. We make no warranties, express, implied or apparent, regarding the Motorcycle, no warranty of merchantability and no warranty that the Motorcycle is fit for a particular purpose.
4. VEHICLE REGISTRATION STATUS
The Renter acknowledges and understands that the Motorcycle may be registered under the personal name of the owner or a related individual rather than directly under the Company name. By entering into this Agreement, the Renter confirms that this registration status does not affect the validity of the rental arrangement and agrees to proceed with the rental under these Terms and Conditions.
5. CONDITION AND RETURN OF MOTORCYCLE
· Motorcycle must be returned in the same condition as received (except for ordinary wear) in the agreed location and time specified in this agreement.
· In case the renter does not return the motorcycle on the agreed date, time and location, an extra day's rental charge will be applied for any late handover.
· You must check and maintain all fluid levels.
· Service to the Motorcycle or replacement of parts or accessories during the rental must have our prior approval.
· The renter is solely responsible for the safety and conduct of any passenger during the rental period.
· The renter assumes full accountability in case of any accident or injury involving a passenger.
· Sub-renting or lending the motorcycle to any other person is strictly prohibited. The renter will be fully responsible for any incident involving that person.
· The motorcycle may only be used within the UAE.
· Off-road use, racing, reckless driving or illegal activity is strictly prohibited.
· Motorcycles should not be used when fluid levels are low, or it is otherwise reasonable to expect you to know that further operation would damage the Motorcycle.
· The Renter is legally obligated to wear an approved protective helmet and all necessary safety gear while operating the motorcycle.
8. RESPONSIBILITY FOR MOTORCYCLE DAMAGE (ACCIDENTS), LOSS AND FINES
All accidents must be reported immediately to the relevant police authorities, and the required police report must be obtained and submitted to us without delay by contacting or messaging us.
The renter is responsible for all traffic violations, parking tickets, and government-imposed fines during the rental period.
You are responsible for all damage to the Motorcycle, including the cost of repair, or the actual cash retail value of the Motorcycle on the date of the loss if the Motorcycle is not repairable or if we elect not to repair it if you are at fault as indicated by the police report.
You are responsible for theft of the Motorcycle, loss of use, diminished value of the Motorcycle caused by damage to it or repair of it, and a reasonable charge to cover our administrative expenses connected with any damage claim, if you are at fault as indicated by police report.
Police reports which do not mention third party or in other words which cannot be recovered against any third party shall not be entertained and will be considered responsibility of the Renter.
If no police report is provided, the renter is fully liable for all repair and recovery costs.
In case of accident and a valid police report, the renter will pay an insurance excess of AED 1,000. However, as every scenario is different, the final responsibility may vary depending on the circumstances of the accident.
Personal Accident insurance cover for the driver in respect of death or bodily injury will not be covered in any case whatsoever.
In case of a total loss arising from your fault, if/as indicated in the police report, you are liable to pay the replacement cost of the motorcycle to us within 30 days of the accident occurring. Failure to pay in case of a total loss arising out of your fault as per the police report may result in us filing legal proceedings against you.
9. BREAKDOWN & EMERGENCY SUPPORT
· If a mechanical breakdown occurs and it is not caused by the renter, the company will provide free roadside assistance within Dubai and Sharjah.
· For breakdowns outside Dubai and Sharjah, the renter will be responsible for covering the pickup costs.
· If the breakdown is due to misuse or off-road activity, the renter will bear full recovery and repair costs.
· All parking, traffic, forfeitures, court costs, towing, storage and impound charges and other expenses involving the Motorcycle assessed against us or the Motorcycle, unless these expenses are our fault.
· All costs, including pre- and post-judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this Agreement.
· You are liable for any damage to the motorcycle while it’s in your possession and will be liable to pay for repairs to restore the motorcycle to its original condition.
11. REFUNDABLE SECURITY DEPOSIT
· A refundable deposit of AED 1,000 is required.
· The deposit will be refunded 7 days after rental return, subject to traffic fine clearance and damage inspection.
· You will not enter the Sultanate of Oman or any other neighboring countries without prior approval from us.
· If you cross the borders without our approval, it will be considered criminal action, and we will have to file a vehicle theft case with the authorities in the country you are in as well as UAE.
· If you have a breakdown due to your fault in Oman or any neighboring country and need to be towed back to Dubai, you will have to pay for the damage repair and the towing charges.
· Your security deposit will be used to pay any damage repair charges, fines or all the above. If the amount of fines, damage, repair charges or all the above exceeds your deposit amount, you will commit to paying them as soon as notified by us.
· Traffic fines do take time to appear on the systems; therefore, we will find out about these after a few days of you receiving them. They are time stamped and we will notify you if they were received when the motorcycle was in your possession. All fines received while the motorcycle was in your possession must be paid by you.
· Failure to pay any due amount which is owed to us by you will result in a complaint being filed with the local authorities to help us claim the amount from you.
· If you wish to extend the rental period, you must contact or message us prior to due date. This Agreement constitutes the entire agreement between you and the Company.
· No term of this Agreement can be waived or modified unless in writing and approved by our company.
· If bad weather occurs on the scheduled rental date and prevents safe motorcycle operation, the Renter shall be eligible for a 100% full refund.
· At the Company’s discretion, the Renter may choose to reschedule the booking for another available date instead of receiving a refund.
· Cancellation terms may vary depending on the motorcycle selected. For full and up-to-date details, the Renter is kindly requested to review the cancellation policy for the chosen motorcycle on our website: https://alrokkab.com/products/pages/returns
· By confirming a booking, the Renter acknowledges that they have reviewed and agreed to the applicable cancellation policy for the selected motorcycle.
A waiver by the Company of any breach of this Agreement is not a waiver of any additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. Unless prohibited by law, you release us from any liability for consequential, special or punitive damages in connection with this rental or the reservation of a Motorcycle. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable.
By selecting the confirmation checkbox, the Renter acknowledges that they have read, understood, and agreed to all of the above Terms and Conditions relating to this Motorcycle Rental Agreement. The Renter further agrees to be responsible for all repair costs or replacement of the motorcycle in the event of an accident, in accordance with the terms of this Agreement.
